Educational Institutions - Subscription Rate and User Permissions

Educational Institutions can arrange a subscription through their Library or an Education Centre. The Terms and Conditions that apply to this type of subscription are

set out below. Where they differ from the individual Agreement Terms and Conditions these Terms and Conditions will take precedence and apply.


Educational Institutions may only subscribe as a full subscriber with the fee for this subscription set at $2,750 AUD/annum (includes GST).


Educational Institutions who wish to restrict access from the electronic delivery and wish to display one copy of each publication from Analysing Agriculture on its display should contact us for alternatives.

1. Scope of License. Institutional Subscriber Use Restrictions
Under this Agreement, Subscribing Institutions are granted a nonexclusive, revocable, non-transferable license to access Analysing Agriculture's Publications
over the Internet via the Subscribing Institution's Internet Protocol addresses (IP addresses). Authorized Users must be employees, faculty, staff, and students
officially affiliated with the Subscribing Institution and authorized clients of the Subscribing Institution's library facilities. This includes occasional users who
access Analysing Agriculture's Publications through stations physically located on the site and under the control and administration of the Subscribing Institution.
Authorized Users includes persons affiliated with remote sites or campuses of the Subscribing Institution that are administered from the Subscribing Institution's
site or campus, but not persons affiliated with remote sites or campuses that have separate administrative staffs and operate independently. Such sites or campuses
must arrange a separate subscription.
This subscription entitles Authorized Users to access Analysing Agriculture's Publications online and:
a) make one hard copy of each publication if required for personal and educational use; such copies must not be shared with non-authorized users. Authorized Users who
do print articles must maintain all copyright and other notices on the printed articles.
b) download Publications to hard disk or other electronic storage device. Authorized Users who do download publications must maintain all copyright and other notices on the publications.
An Authorized User may not make any Analysing Agriculture Publication available electronically to any other person, whether by telephone link or by permitting access through
a terminal or computer or by any other means or arrangement. This Agreement is enforceable only against and by the parties who have executed it; the Agreement neither
creates nor restricts rights in third parties.
Analysing Agriculture understands that the Subscribing Institution is unable to practically enforce the terms of the Agreement for third parties. However,the
Subscribing Institution agrees to make reasonable efforts to take appropriate action should they become aware of any misuse that would violate the terms of the
agreement and that the Subscribing Institution will continue to promote an environment that does not allow for abuse of the terms of the Agreement such as regularly
changing the allocated password to Analysing Agriculture.
2. Terms and Fees
This Agreement will last for a 12 month period from the time of first subscribing to Analysing Agriculture. This Agreement will remain in effect thereafter for
successive subscription years so long as annual subscription fees are paid, subject to any new terms and/or conditions required by Analysing Agriculture at that time
and shared with the Subscribing Institution 30 days in advance.
Both Analysing Agriculture and the Subscribing Institution have the right to terminate this Agreement at the end of a subscription year by written notice given at
least 30 days before the end of the subscription year. Access to material via the Analysing Agriculture Online website is for the length of the Agreement period only.
There is no access to material via the Analysing Agriculture Online website after the Agreement is terminated.
Analysing Agriculture reserves the right to suspend or terminate access to Analysing Agriculture Publications online without prior notice if the Subscribing
Institution or any Authorized User of the Subscribing Institution violates any term of this Agreement.

Analysing Agriculture is the owner of all right, title, and interest, including copyright, translation rights, redistribution rights, and the right to produce the
material in alternate media, for any and all material that can be accessed under this Agreement.
Analysing Agriculture Publications and their content are subject to copyright, database protections, and other rights of the publisher under the laws of the Australia
and the country of use.
The Subscribing Institution acknowledges that it has no claim to ownership by reason of its use of or access to Analysing Agriculture Publications.
Downloading or photocopying of the data is permitted for personal or educational use. Other recompiling, copying, publication, or republication of the data, or any
portion thereof, in any form or medium whatsoever, may be done only with specific written permission from Analysing Agriculture.
5. Disclaimer of Warranties
Analysing Agriculture warrants that it has the authority to grant the License as described in this Agreement. Analysing Agriculture has made and will make reasonable
efforts to ensure that Analysing Agriculture Publications are complete and accurate. However, Analysing Agriculture does not warrant their completeness or accuracy
and does not warrant that the Subscribing Institutions or any Authorized User's use of Analysing Agriculture Publications will be uninterrupted or error free, or that
the results obtained will be useful or will satisfy the Subscribing Institution's or any Authorized User's requirements. Analysing Agriculture makes no other
warranties or representations of any kind, either express or implied, including but not limited to, warranties of design, merchantability or fitness for a particular
purpose, or arising from a course of dealing, usage or trade practice.
6.  Liability
Subscribing Institution's sole and exclusive remedy for damages and or loss in any way connected with this License shall be limited to the amount of the License Fee.
Under no circumstances shall Analysing Agriculture be liable to the Subscribing Institution or any other person, including but not limited to authorized users, for
any special, incidental, or consequential damages of any character, including without limitation, damages arising out of inability to access Analysing Agriculture's
Publications or errors or inaccuracies in the publications' content.
7.  Delays
Neither party shall be responsible for delay or failure in performance resulting from acts beyond the control of such party. Such acts shall include, but not be
limited to, an act of God; an act of war, riot, epidemic, fire, flood, other disasters; or an act of government.
8. General
a) This Agreement constitutes the entire Agreement between the parties hereto and supersedes all prior oral and written and all contemporaneous oral negotiations,
commitments and understandings. The various headings in this Agreement are informational only and do not limit the scope or content of the subject matter contained
therein. No waiver, amendment, or modification of this Agreement shall be effective unless it is in writing and signed by the parties hereto.
b) The Subscribing Institution may not assign or transfer its rights under this Agreement.
c) Should any provision of this Agreement be held to be void or unenforceable, the remaining provisions shall remain in full force
